claim against and estate

my mother died leaving only a house on 1 acre of land to me and my dad. this was personal property since she was sole owner before she married her 3rd husband he also had a home that was personal property. now they are both deceaced and his niece is making a claim against her estate can she do that?

Yes. Heirs can file claims and creditors can file claims. Whether those claims will stand up to scrutiny is another matter. You say your mother left her home to you and your dad; did she do this via her will? Was her 3rd husband your father? I am confused about the relationships here. It is critical that the exact nature of one's relation to another be determined, so call me or another lawyer and discuss with him/her.
