Legal Question in Immigration Law in Argentina

affadavit of support

my neice is requesting that I sponsor her husband from Argentina to come to this country. She is 21 but could not meet the financial requirement. I am hesitant because of the 10 + year commitment. Are there other options to get her husband into the U.S.?

I assume that your niece wants you to be a joint sponsor for the Affidavit of Support. You are quite right to be wary of accepting this responsibility, which could be indefinite. Your niece might be able to use assets to meet the income requirements, or find another joint sponsor. For more details, including your obligations if you do jointly sponsor this man, see here: http://www.martinvisalaw.com/affidavit_of_support.html. and http://martinvisalaw.blogspot.com/search/label/affidavit%20of%20support

Re: affadavit of support

Dear Inquirer:

Your niece will need a US Citizen or Green Card holder to be a joint sponsor on the affidavit of support if she wants her husband to come here. Note that if he becomes a US Citizen, you will be exonerated from further liabilty on the affidavit of support, which could be as little as 3 years after he gets his green card.

I recommend that you email me at [email protected] or visit www.hanlonlawgroup.com if you would like to schedule a confidential consultation to discuss this matter further.
