Fraudulent Schemes

I was charged with fraudulent schemes. I was tod to sign a written statement and that nothing would happen. Instead I was taked in and charged. What will happen when I do to court? Will I have to do jail time? I have nothing what so ever on my record.

If you are actually charged, you will either receive a summons to appear for an arraignment(where the court formally tells you of the charges and you plead not guilty) or will be arrested pursuant to an arrest warrant. About 45 days later, you will have an initial pre trial conference. Prior to the that your attorney will have shown you any discovery they have against you and a plea offer if there is one.

As for what will happen, that really depends on the facts. You will have to have a lawyer assist you, whether private or a public defender.

If you signed a statement that said nothing would happen your attorney needs to file a motion to enforce this non-prosecution agreement. If the agreement was you were not to be charged in exchange for your cooperation the court will enforce such an agreement and dismiss the charges.
