Reverse discrimination - slander ???

My brother (white) was jumped in a convenience store parking lot by 3 men (black) very late at night and suffered some minor injuries. Almost 2 weeks later he got a letter from the police dept asking him to come down for questioning telling him he was being accused of a hate crime & could result in prosecution & up to 10 years in prison. The description that was given to the police was WAY off. They put an extra 50 pounds on him said he had a shaved head (short hair but not shaved), nazi and white power tattoos (has tattoos but nothing that can even be innocently mistaken for white power), and claimed that he jumped them. He has a witness that says otherwise but is there anything that he can do about being falsely accused?

They will investigate and submit to the county attorney's office if they think there was a crime committed. It is the county attorney's office that decides whether or not to prosecute. What I would HIGHLY recommend...is that he NOT talk or go there without representation. Even though he has nothing to hide, many statements can be misconstrued.
