Legal Question in DUI Law in Arizona

D.U.I.

I had an accident back in december, I had been drinking earlier that night about 3 hours prior to my accident. I fell asleep while driving, they want to charge me with a dui but the officers never told me what my blood alcohol level was. this is my first offense ever, I'm trying to get an idea about what the judge will order me to do.

there are a variety of issues. If you caused an injury accident then you could be charged with an Aggravated Assault, Dangerous Offense and could see prison time. If the accident did not involve an injury, you could be charged with a DUI or Extreme DUI depending on the BAC. You will learn the results at your hearing when and if you have one. If it is regular DUI then you should be able to negotiate for one count of DUI with 10 days in jail, all suspended but one plus a fine. If Extreme (over .15) then you will have 30 days in jail, all suspended but 10(you may be eligible for work release-10 hours in and 10 hours out) plus a fine. With both, you will be required to attend alcohol screening first before they will suspend the jail time. You will have to complete any classes that the they recommend. If there was damage, you might have to pay restitution to repair the damage(not to your car).
