Legal Question in Family Law in Arizona

Custody Issue

I have a child with a woman .. there is no custody papers, we made an agreement on custody and she has broken her word on it. I live in Texas .. she says her state of residence is Arizona. What i am asking is how do i file for custody while living in another state or can i file for it in my home state?

Re: Custody Issue

Where you file depends primarily upon which state is the child's "home state". Without hearing more, my guess is that you must file in Arizona.

There are several ways to initiate a case, depending upon whether she will agree that you are the Father, or whether your name is on the birth certificate, and that such is signed by both of you. If neither of the above apply, you can file a "Complaint in Paternity", simply alleging that you are the Father.

I can explain the procedures better by phone or in person. There is too much to cover via e'mail (and I am not the greatest typist). We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Cathy to schedule a free 1/2 hour consultation. I look forward to talking with you.
