Legal Question in Family Law in Arizona

Divorce

Can my husband whom lives in Tucson, AZ divorce me, while I am here in NJ? Without my permission?

What about our joint bank account? Can he remove me from it?

Re: Divorce

You should beat him to the punch and file for divorce in New Jersey, if you have lived in New Jersey for a year.

Whether he can take your name off the joint bank account, I would think that he would need a court order to do that if both you and he signed the signature cards for the accounts creating a contract between each of you and the bank. On the other hand he could simply draw all the money out and place it in his name only. In New Jersey the money would still be your joint marital asset and subject to equitable distribution in a divorce. I

would expect that Arizona law would make the joint account a marital asset, also.

Call me if you like.
