Legal Question in Family Law in Arizona

My husband and I feel it is necessary to attempt to file for incompetency regarding his brother. His brother has consistently demonstrated an inability to handle his prescription medications, overdosing on a regular basis. We are in the process of having him sign to allow us to communicate openly with his prescribing physicians in an attempt to work with his doctors regarding his receiving and filling any prescriptions. He demonstrates significant impairment in his judgement regarding his financial and self care skills. We feel this action is our only recourse to ensure he receives the medical and mental health care that he needs, and to ensure his safety.
