Legal Question in Family Law in Arizona

I've been married for almost 7 years and I've been a stay at home mom further, full time to 2 sons with disabilities... My husband is a Doctor of Chiropractic and we started and own our wellness clinic and spa together debt free as well as both of our vehicles are paid for, the business loan and we share a portfolio of investments, business bank accounts both personal and professional. I just underwent a knee surgery and will need to have a 2nd operation in Oct. We both agree that joint custodial care is best, but I'd like to know my rights and if we would be best served to handle everything on our own with exception to the financial arrangments of spousal support, financial division, income earning and splitting out time with our sons. We are both from the Midwest and I don't know anyone in AZ that has divorced and wouldnlike to protect what's in my best interest and the future in supporting my sons and my role as caregiver. Thank you for advising meningitis theRight direction. I am aware that it's a No Fault state and we are in agreence that marriage for us in general to each other is just not working. Kindest regards, MY2SONZ

You and your husband may very well be able to work out some or all of the issues in your divorce; however, I still recommend that you at least consult with an attorney to discuss your options. If you and your husband can settle between the two of you, then a lawyer can help you properly draft the documents. If you can't reach full agreements then a lawyer can help advocate your position and hopefully negotiate an amicable settlement.

We offer a free initial consultation, so please call our office to schedule a time to speak with one of our attorneys regarding your best course of action.

I would strongly suggest you visit with a local lawyer. There is nothing bad about spending some time and money talking through all of the issues with a lawyer first. Don't do anything before you are educated on the issues. You will feel significantly better about agreements if you do. Reaching agreements is the best thing someone can do but ONLY if those agreements are fair and equitably. Considering all you have done to build this business for example, I would not want to see you reach agreements on your share without knowing full well what your rights are. This does not mean you have to battle or spend thousands of dollars needlessly. You want a lawyer who is experienced in settlement to guide you through this process. As for moving, again, you need to discuss this with someone because relocation is another difficult issue. If your husband is willing to agree to this, it's a great thing for you because relocation is hard to accomplish(judges don't like to separate parents from children)

Feel free to give my office a call.

There is far too much to cover by email. We can certainly help you consider and then pursue your options for divorce. This is obviously a very important matter, and you should not go in alone.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gloria or my paralegal Jennifer to schedule your free 1/2 hour consultation.

PLEASE REQUEST ATTORNEY CARLIE OWLSEY WALKER, in my office, WHO HAS SIGNIFICANT EXPERIENCE IN THE DIVISION OF A CHIROPRACTRY BUSINESS.
