Legal Question in Family Law in Arizona

My pending divorce decree stipulates that child support was to start on December 1, 2010. There is not a temporary child support order. The divorce stipulates that child support is to be paid via the state of Arizona's payment system. The court clerk is unable to generate an ATLAS number which is required to pay via the state's system until the divorce decree is signed by the judge. My question is will I have to pay back child support once the divorce is finalized?

Not sure I understand your question. If you are asking whether you have to pay it dating back to December 1 even though there is no account set up yet then the answer is yes. Either you should send it to the clearinghouse with your case number on the memo part OR pay to the other party directly but ask that he or she sign an affidavit of direct payment that you can obtain on line. You can then provide that form to the clearinghouse for their records. Make sure you keep a copy.
