wife support

I am in the US. Army and my wife wants a divorce. I am being evuated for a medical discharge, my question is is she able to take part of my disability, or only part of what I earn through employment? I know that as long as I am in the Army she gets my BAH, but after I need to know.

Re: wife support

It depends upon what you are being compensated for. If it is for loss of future earnings, then she is not entitled to part of those earnings once you are divorced.

However, if it is compensation for past losses, those may be community in nature.

I can explain the issues better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Jennifer to schedule a free 1/2 hour consultation. I look forward to talking with you.
