Legal Question in Real Estate Law in Arizona

Is a non-conforming (size) lot created as residue of a split, grandfathered?

The lot is 2.75-Acres, zoning requires 4.2-Acres. 2.75 was okay at the time it was created. Local County Zoning laws (our Zoning Code) say the lot has to be recorded (doesn't say by who, the Treasurer & Assessor "recorded it" and made a separate tax-bill and Assessment). I'll probably need a Court Opinion to beat this. Thanks!

The County zoning law must conform to state law. You may be able to avoid the separate assessment.
