Are you allowed to spend money of the deceased without settling the estate?

My mother passed 12/23/06 and her estate has not been settled. My brother, the executor says there is no money. She inherited $100,000 from my sister who died 3/12/06. My mother lived with my brother for 7 months. What rights do I have?

something appears to be wrong. Was the will admitted to probate? If so, you are entitled to an inventory and accounting. More facts and investigation are needed here. Consult with an estate attorney.
