Punitive Damages

My wife was in her employers truck when they were rear-ended. he did not have workers compensation insurance or vehicle insurance. he has ignored and failed to reply to the state WCC people and has shown no concern for his employees health or well being. we now have finally got a date for the WCC pre-hearing but was wondering if there is any other suit that could be brought against him?

If an insurer has Workers Comp. insurance, that is generally the only remedy for nonintentional injuries that occur at work. I don't know whether Workers Comp. will kick in on this matter, but if not, it is possible you may have another action, or suit, against the employer. Possibly even if it does.

I think you may want to consider consulting an attorney regarding your options and rights by sitting down and going over all the details of this incident. I need more information to give you a more definite answer.
