Legal Question in Intellectual Property in Arkansas

inheritance of copyrights

My uncle held several copyrights of music CDs he issued on his own label. When he died, he left his estate to me but did not specifically mention the copyrights. I contacted the Copyright Office about having the rights transferred to me as his heir, and the representative said I cannot do that myself as they were not specifically mentioned in the will. He said I would need to get legal advice. Can you help? I would like to be the registered owner of the copyrights. My uncle was a resident of Tennessee and I live in Arkansas.

Re: inheritance of copyrights

The inheritance of the copyrights is determined by the residuary clause or the laws of intestacy depending on the structure of the will and its contents.

After determining the owner, documents can be filed to change the ownership of the copyrights to the proper person(s).

If you wish to discuss this further, you may contact my office via email or telephone at 702.430.1375.

Good Luck.
