temination of a lease

I would like to terminate my lease with my landlord. He has told me that I have to pay the remainder of the lease which is 3 yrs. I signed a five year lease. I am wanting to expand my business and he says that I can not sublease. My profession is in the salon business. I do have one boothrenter. He has stated that I cannot have anyone else in the salon with me. I have found another building and would like to terminate my lease without having to pay for the remaining 3yrs. I know that there may be penalties for terminating early. If you could give me some advice on how to handle this situation legally I would appreciate it.

First of all, I would have to see the lease document to be sure about any of my answers, because the lease can state whatever it chooses to as far as limiting or allowing.

Such as, does the lease say anything about subletting? If not, it is possible that you can do so. Does it specifically say you can't have someone else working in there? If the other booth works with you, it is unlikely that he can prevent that unless the lease is very specific to not allow that.

As far as how much you'd have to pay, I can't say for sure. When you break a lease, you owe for the remaining months, IF the landlord can't rent it. He has a duty to attempt to find another renter. You could be held liable for the months it is vacant and, possibly, the cost of advertising to find another renter. If the lease says anything about what happens if you vacate early, it is possible that will stand unless it is totally out of line and unfair.

I know most of these answers are somewhat vague, but I need to look at the lease to give more definite answers.
