Legal Question in Medical Malpractice in Arkansas

incontinence after TURP surgery

On July 1 of this year my husband had TURP surgery for BPH. My husband is 54 and in good health. The dr. told him it would be 1 night in the hospital. He ended up staying 3 nights and came home with a foley catherer which was removed 6 days later. As of this date, Dec. 26, my husband has no continence. The dr. kept reasuring him that it would just "take time" to heal. After finally looking up the bladder in Oct. you could see where nips had been taken out of the sphincter muscle. The Dr. then wanted to do Collegen injections. He did one in November, which did not make any difference. The Dr. now wants to insert a artifical sphincter. We have checked many sources and have found no one else who has had this surgery having incontinence after 6 months. We feel the Dr. got too aggressive, took out too much tissue, and damaged the sphincter muscle, which now cannot be repaired. We consulted a 2nd dr. in a larger city in Oct. he also felt the Dr. was "too aggressive" when removing tissue. We have had our lives destroyed, as it it impossible to go anywhere. He is wearing an external catherer, which limits where we can go. We feel that the reason the dr. wants to put in an artificial sphincter is to cover up his error. It is a device that has to be opened and closed everytime he wants to go to the bathroom for the rest of his life. We are not in the process of seeing another dr. who will now try to correct the mistake this dr. has made
