My husband was involved in an accident, which occured in an area where the road widened in order to create a right hand turn lane.My husband started to get over into the widened lane before the solid line began on the pavement marking the actually turn lane.The traffic to the left of my husband was sitting at a red stop light when a truck in that lane decided to pull into the gas station located on the right hand side of the road.The driver of the truck put on his turn signal and began to turn into the gas station striking my husbands vehicle in the drivers side door and window.Since where my husband was located at the time of the accident was not considered a section of the turn lane, due to the fact that the solid line had not yet begun, my husband recieved a warning ticket for the accident.We have insurance, and therefore did not think twice about the accident since both my husband and the other driver drove away from the accident.It appeared as if everyone was okay.Now we find that a civil suit has been brought against my husband in the amount of $1800 for pain and suffering.The driver refused medical care at the time of the accident.

I disagree with you getting the ticket. When traffic is stopped, it is OK to passs on the right. It is the responsibility of the other guy to look and see that he is not about to hit something. If he hit your driver's door then it is apparent that had he looked at all the accident would not have happened. Now then, considering that you have insurance, deliver the summons to your ins company and they will fight it for you. If you loose, they pay. If you win, they do not pay.

If no answer is filed within 20 days of them serving you, then you pay and the ins company may not have to pay you back!
