Legal Question in Banking Law in Australia

$1000+ fee due 2 'legal proceedings' i know nothing of

I have a bad debt I am paying off with my bank. I called today to find out what

the final figure was as I had $100 and $243 showing on the internet. Bank

returns my question with well actually figure s/be $1300 due to legal

proceedings in June 2004!! I haven't gotten any paperwork on this fee and

only found out about the fee until i called them. Can they do this and do I

have enough reason to chase it further or do i just pay it?

Call the bank, explain you know nothing of the Court case and costs, and ask them to waive the costs. Pay the balance actually due the bank but not the Court costs. If you did not actually receive the proceedings at all, then no Court will make you pay. Banks like to do the right thing, call them and be nice, see what happens!
