Legal Question in Family Law in Australia

Extended holiday

My dsughter has been on holiday with her father for the requried 3weeks in New Zealand as stated in the court order. I have arranged for her to stay longer with a friend however her father wont let her go with my friend, can i get help from the police authorities in New Zealand if he does not allow her to go? It does not say that she is to be returned to me after the 3wks.

Re: Extended holiday

The father is not obliged to let your daughter go to stay with her friend. He is only obliged to comply with the order. The NZ police don't have power to take action.

My suggestion is that you return your daughter to NZ to stay with her friend once she is returned to you. You also have the option of making an application to court ot vary the order but that would be costly and time consuming and probably wouldn't be heard in court until after your daughter comes back to you anyway.
