Much depends on the chapter 13 trustee's policies. If you have simply received a letter you probably have not been officially "dismissed" in terms of an actual court order being entered. Contact your attorney or go yourself to the hearing and ask the trustee's office what can be done. Remember also, that even if your case is dismissed you have an almost absolute right to refile. Of course, this would mean you would have to repay the $185 filing fee, and if you have filed several times and been dismissed several times the trustee or a creditor could file an objection seeking a dismissal and permanent ban on your ability to refile. ph.
