Case Management Statement

I am a plaintiff in pro per in a civil case against a couple of defendants. One of the defendants who is also pro per never submitted CMS to the court before the Case Management Conference that was two weeks ago.

Is this allowed for the defendant not to file his CMS with the court. Do I need to file any papers to ask the defendant to file the CMS or for the court to sanction him?

Everyone is supposed to file the CMC. The Judge will be aware it was not filed and will bring it up. Most judges would not sanction a person representing themself for not filing, but if occurs another time they might. Since the CMC already occurred, you can not complain about it now. It is better to send interrogatories and production requests to find out the information you would get from the CMC.
