Legal Question in Appeals and Writs in California

The E.D.D.claimed that I gave false information when I applied for benefits. I have evidence that shows and proves I gave my correct information. My evidence also shows that the E.D.D. is responsible for the errors on my case. The E.D.D.s court used a untimely appeal to ignore my evidence that proved my innocence and said they did not approve of my reason for the untimely appeal so I had to pay over 1,200.00 dollars - I was forced to accept a black mark on my record saying that I gave false information and I cant use my benefits. This is not justice. Can someone please help me get justice?

Your major problem is that you filed an untimely appeal which can be determinative. On the decision by the administrative law judge turning down your appeal should be information on how to appeal to the California Unemployment Appeals Board (CUAB). You should appeal on the issue of timeliness. Your first step will be file a notice of appeal. Then you should file a request for a transcript of the hearing before the administrative law judge. Then you will write a letter to the CUAB telling why you think your appeal was timely. If you are doing this without a lawyer (which might be your problem in the first place) you should go to a law library and ask to see copies of the CUAB's precedential decisions.
