Whether it is in bad taste or not depends on whether you cannot pay ANYTHING for his services, or merely do not want to pay. Appealing a denied writ of habeas corpus requires skill. It cost the lawyer many thousands of dollars to acquire that skill. You ask her to give up time she is charging someone else for, to work on your case for free. Why would they do that?

It is my understanding that appellate counsel can be appointed for indigent defendants who are appealing a decision. It has been awhile since I read anything in this area, but I'm sure it extends to appealing a denied writ of habeas corpus.
