Legal Question in Bankruptcy in California

Bankruptcy and Chexsystem

Last year I tried selling my car and ended up falling for a scam. I was given a fake cashiers check, which my bank only figured out about a month later. By then I had already used the money and had no way of paying it back. I did file a police report and had called my bank with the number. They then sent it to a collection agency. A few months after that I declared bankruptcy and everything was discharged as of Sept of last year. I got married after that and in Jan/05 tried to open a joint bank account and was then told about chexsystem, I got the report and it states account abuse, which is not true. How do I get that cleared, and should it have been cleared already since my bankruptcy was discharged?

You should send a certified letter, return receipt, to Chexsystem and tell 'em what happened. Ask them to remove the derogatory information, and give them a reasonable deadline (maybe one month). If the derogatory information is hurting your ability to get credit, contact a lawyer and see if he or she can do something about the defamation.
