Legal Question in Bankruptcy in California

New bankruptcy law and filing

I last filed for bankruptcy 3/29/99. I need to file again, but it is my understanding that i need to wait till 1 day past my previous filing date. I am concerned with the new bankruptcy law going into effect--will I have time? Was I given correct information? I am concerned about this new law going into effect and no debt relief. Thank you.

You're correct about the timing. If the bills were to pass Congress, more than likely there would be a waiting period. But that's not a guarantee. Right now, the bills have been re-introduced, but haven't been acted upon. The bills were held up during the past few years on whether judgments against anti-abortion protesters should be dischargeable. I cannot predict what will happen with this volatile political issue, however.
