Legal Question in Bankruptcy in California

Is Bankruptcy right for me?

Here is my situation. In the last year I have become increasingly in debt. I owe the IRS, CA State (EDD), The county of Sacramento, a rental furniture company, student loan of around $15,000, and not to mention a judgement for an eviction that the judge was supposed to review but ruled in favor of petitionor (and stated that we were not in at the proceedings when we were). At any rate I am around $25,000 in debt, temp worker who has 3 young children to support and health problems due to stress over finances. I have often considered bankruptcy but don't know much about it and wouldn't know where to begin. Need help with what options may be best for me. I am truly exhausted with the constany worry, always wondering ''will this be the week someone garnishes my check'', please help me. Looking for the cheapest way possible to get out of this mess.

Thank you

You do have bankruptcy options available. The type of bk that would be best for you will depend a lot on the tax years involved and just how much trouble the student loan is giving you right now. The other debt sounds like the type that would go away in any kind of bk. If you would like a free consultation, please call me at 415.495.2224 or e-mail me at [email protected]. Re: Is Bankruptcy right for me?

At this time your tax debt will not be dischargeable in a bankruptcy unless, at a minimum, it is for tax years prior to 2001. The student loan debts are also not dischargeable. Your remaining debts probably would be. If you would like a free phone consultation, please visit my webpage at http://www.bklaw.com/consult.html and then contact me to schedule an appointment. I will be happy to go over your situation with you.
