Legal Question in Bankruptcy in California

Car Loan

I recently filed Chapter 7, before the

meeting of creditors, I received a

motion for Relief from Stay from my

car finance company. I am not

interested in keeping the car and did

not intend to re-affirm the loan. My

concern though is by filing the relief

from stay, will they be able to collect

from the me the balance of the loan

minus the auction price?

No. They likely only intend to repossess the car. You might call the attorney and make arrangements for its surrender.
