Legal Question in Bankruptcy in California

File or not to file

My son was injured OTJ 2 1/2 yrs ago plus vet with post traumatic syndrome, got into financial problems. He now has very bad credit cannot get loan to consolidate. Owes around 17K on car & CC. Car too old company will not repo CC high interest. Can't cover interest on cards (no charging) or pay car pymnt. Makes $11/hr 35yo wife wks also. 1 child. rent apt. He cant tread water, been in contact with creditors to work with them but they threaten to sue. He is responsible, just a lot of bad luck lately. Should he file? What will it do in future for new car or home loans when he is on his feet.

He is trying to go to school so he can get a better job but with working full time it will take several years. Anything we can do?

Re: File or not to file

This sounds to me like a situation that will be improved by filing bankruptcy. The only way to know for sure is to do a full intake to get more information. But on the surface, he seems like a good candidate. And yes, it's very common for people to buy houses and/or cars after bankruptcy. I've arranged many mortgages for people following bankruptcy so I know it can be done. If he wants to discuss further, I offer a free consultation. Best of luck.
