Legal Question in Bankruptcy in California

What steps do i take to file bankruptcy and how will it effect me.

My husband and I wanted to know how to file bankruptcy. We have alot of debt due to letting bills go to take care of out sick child that died last year. I was not able to work due to being sick myself and husband got out of the military and we have no way to meet our bills. We are 24 and

28 years old. We hava a car that we finance and our still getting hospital bills from our son. Do you think bankruptcy is right for us our basic debt is around ten thousand dollars but we also had an automobile accident where statefarm is asking us for 105,000.00 in damages to there client.

Filing bankruptcy all depends on where a person or family wants to be. Of course, it will have a negative impact on credit. It will remain on the credit report for 10 years. People have been known to buy houses after a few years if they have a sufficient income, of course. I'm curious about the accident. Obviously, someone was hurt. I or any other lawyer would want to look at the facts of that accident to make sure it was not a deliberate occurrence or one that happened while driving under the influence, whether you had insurance coverage at the time of the accident, etc. Feel free to contact me privately for more info.

$115,000 of debt is certainly sufficient to consider a bankruptcy filing. If you would like a free phone consult, please visit my webpage at http://www.bklaw.com/consult/ to schedule an appointment.

From the facts given, you should STRONGLY consider filing bankruptcy, rather than trying to satisfy your pending creditor obligations, or settling the debt for a significant discount. There are ramifications naturally, but bankruptcies can be wiped away from your credit reports even before the usual 10 year period, and you can begin rebuilding your good credit and reputation shortly after filing, with the help of an experienced attorney. For prompt, effective and very affordable legal assistance in these matters, contact us today for a free phone consultation.
