Legal Question in Bankruptcy in California

Stopping Wage Garnishment

I am intersted in knowing if there is a way to limit or stop a wage garnishment without filing a bankruptcy. The opposing side has been unreasonable from the start.I never was presented a opportunity to settle @50% prior to the lawsuit.

Re: Stopping Wage Garnishment

You can file a Claim of Exemption. The forms are available online or you can get them from the Sheriff's department. You will out a financial statement and file it with the Sheriff. You can request a lower amount to be withheld or none at all. If the creditor objections, the court will schedule a hearing on what the amount should be.

The court has already ruled how much you owe. If settlement negotations fail, the creditor is under no legal obligation to negotiate with you.
