Subrogation claim

I'm being sued in BK Court by an insurance co who paid out a claim to an ex boss for ''fraud'' against me. It was never proven in court and he dropped the civil case and even though the ins. co knew about it they didn't intervene. Now 2 years after the case was dismissed the insurance carrier is suing me in subrogation. I know it's past the statue of limitation for fraud, is the insurance company not subject to the statue of limitation?

The statute of limitation for bringing suit to collect on subrogation is three years from the date of the payment.
