Legal Question in Business Law in California

Auto repairs

My car has been in the shop for over 4 months. He has worked on my car in a piece meal fashion. He has had some personal family problems and I believe he is working on numerous other cars all at the same time. My car was towed to his shop in August. I have tried to be patient and understanding. He keeps making promises and fails to complete the work. His shop specializes in Jaguar repairs and since I have had work done by him in the past, I trusted him. I have been the one to call him concerning my car's status. I visited him with my dad (past customer himself) and he keeps promising my car will be ready soon (next day or sooner). He has been doing this for the past 6 weeks. I can not be that patient anymore especially when I need my car. He is a nice man but that isn't getting my car to me. I need advice. What can I do about this? I feel that he is taking advantage of me. I have wondered if he is just tending to the other cars of people who are less understanding. In other words... " the wheel that makes the most noise gets the attention." I am now questioning his professional ethics. The work he has done wasn't even that major. It had to do with an online computer. Thank you.

I would call him and tell him you are coming to pick up the car in 2 days, ready or not. Tell him if he has it fixed when you get there then he will get paid.
