Legal Question in Business Law in California

If a corporation gives it's employees loans to help with living expenses regularly and denies one of there other employees the same loan, can the company be in some serious legal trouble for that? This particular employee is going through a very messy divorce with the owner of the companies niece but the employer stated they didn't have the funds at the time to give the employee a loan.
