Legal Question in Civil Rights Law in California

Are bouncer's at clubs allowed to confiscate driver's licenses just on suspicion and keep it even if shown proof of validity??

I'm 23, on Monday a bouncer confiscated my driver's license saying that the picture didn't look like me and now it's thursday and they refuse to give it back. Shouldn't that be illegal? what right do they have to keep a state id and couldn't that be a threat to identity theft?

They are just citizens, and have no further rights than any other citizens. As a citizen, they are entitled to make an arrest for a misdemeanor that they witness. It is doubtful that they can prove that they witnessed a misdemeanor in their presence by you providing your driver's license. I suggest that you get a lawyer to write a letter to the bar to advise that you will file a suit for a number of reasons and the bar will probably back down. Since I am not paid, I am not going to research all the reasons that you can sue the bar.
