Can someone take a person to Small claims court if the case is still pending in the DA office and if you were never charged with the crime?

Yes, the criminal prosecution and civil case are separate proceedings. Even if the defendant was found not guilty of the crime plaintiff can still pursue civil remedies. Look at what happen to O.J.
