Legal Question in Constitutional Law in California

My school is in swim unit. They mark you down even if you dress out in PE clothes. In order to make this up they make you go to after school PE make up. I don't have time for this and was wondering if there is a legal way i could get out of this with out swiming or going to PE make-up. A parent can only get you out of it for 3 days. There has to be some legal way to get out of this that i can bring up.

You have posted this question at least four times, albeit with slight edits. (This time, for example, you left out the part that says you don't swim "for various reasons" but which conspicuously fails to say what they are.) I've already explained that, unless you have a medical reason why you can't take swimming lessons, you have to complete the requirement. Courts aren't going to excuse you just because you want an excuse. And if you "don't have time for" your school's requirements, you won't graduate.

You need to accept the fact that there are rules in life which you will have to obey. The legal system isn't here to help people who want to shirk their obligations. To the contrary, it's here to enforce those obligations.
