Can this type of lawsuit be filed without an attorney.

With very few exceptions, individuals have the absolute right to represent themselves in civil litigation. So yes, you can legally represent yourself and some people successfully do so.

But should you? That's an entirely different question. The fact that you even asked this question is proof enough to me that you should at least talk to an attorney about your options before proceeding further.
