Legal Question in Consumer Law in California

Auto dealer fraud

We have a situation where the dealer has committed fraud. He charged our credit card but did not disclose that amount in the contract. He gave us a due bill but the item does not appear on the contract. We are not sure what he really gave us for our trade-in.

Also he allowed us to take the vehicle overnight and drive it as much as we wished without dealer plates and according to the CHP that makes the vehicle used. The dealer shows 20 miles at delivery yet we put on over 70 miles driving it overnight and even had to put fuel in it.

We have a lemon claim against the manufacturer but have been advised to contact a lawyer who handles fraud. We have all the documents to back this up. The dealer has also threatened to sue if we continue to inquire into this deal.

Re: Auto dealer fraud

Unfortunately, what you describe sounds very familiar to me,. You do not mention any defect in the mechanics of the car so a "lemon law" probably doesnt apply, however your correct in inquiring whether a fraud occurred. My office handles consumer/auto dealer cases. I would need more information to properly advise you, feel free to contact me via phone or email.

Yours truly,
