Legal Question in Consumer Law in California

charge

Avon charged $100 to my acct for a conference that is being held this August. I signed up and then realized its for leaders and I am only sales, so right away I notified them and they said its non refundable, this is going on back and forth, I did not pay it was charged to my acct. and now they said if i dont pay in 10 days it goes to a collection agency, I think this is unfair as for a month now I been on the phone and emails with them. it is a charge where now I cant order or have access to my acct unless i pay this, was an error, please tell me what I should do, thank

Re: charge

I would politely ask them to either let you attend the conference or to refund the money. Hopefully attending will be valuable to you.

As for a refund, whether or not you are entitled to one is not that important. Even assuming you ARE entitled to a refund, it looks like it will be World War III to get it back.

If you really want to fight for the refund, look up the following as they apply to contract formation/interpretation: mistake (mutual mistake), frustration of purpose, impossibility. Some of those may apply. It would probably take thousands of dollars of an attorney's time to really give you specifically-tailored advice or opinions.

Good luck.
