Legal Question in Consumer Law in California

i lease a laptop from rent a center a few months ago. it was a gift for my friend, she took over payments, she even went down to rent a center to change it in her name. she was told by rent a center that the account was switched over to her name. a couple months later she was unable to pay for the laptop and didn't want to give it back. rent a center started calling my contacts asking about her. i called rent a center to ask them why are they calling my contacts. they then realized that her name was just added on my application and they did not switch the account to her. now they want me to pay or come up with the laptop. which A.) i'm not paying for their mistake and B.) i have no idea where she is right now. someone in her family died and i heard she went back home to help. What are my options and can i fight this?

Ask for a copy of the contract. They may be telling you one thing just to motivate you to tell them where she is.

If you are sued by the rental center, then you should cross-complain against her. Until you see the contract, I would not take their word for it that she was just added to your contract. If you are on the contract, the rental center should have no problem showing you the contract.
