Legal Question in Consumer Law in California

Hello, about two months ago I bought a car, and the person I bought the car from, told me there wasn't any problems with the car, then, I went to the DMV to register the car, but when i was trying to, they told me that I could not register the car under my name, because the car was bought at an auction and it was suposed to be taken out of the country, apparently, the car can be register anywhere else but California according to a new law, I talk to the person I bought the car from, and he told me that it was just matter of time and that they were going to do all the paperwork. I waited more than a month and they couldn't do a thing, so I claimed the money back, and they ask me for ten days, it's been two weeks now, and I just don't know what I cam do to get my money back, should I suit them? or should I file a claim in the DMV? please, I need some advice!! thanks!!!
