Legal Question in Consumer Law in California

Sales on Apparel

Can I sell embellished apparel on the internet or anywhere else that have NFL logos on them with team names? Example: CHARGERS in rhinestuds with the Lightning bolt. No where on my apparel will it say that it is from the NFL.

Re: Sales on Apparel

You cannot legally sell those items without approval from the teams and/or the NFL. It is all protected by intellectual property rights and the NFL is pretty aggressive when goes about enforcing those rights, especially around this time of year because of the Superbowl.

Re: Sales on Apparel

If you buy officially licensed merchandise, modify it, and then resell it, that's probably okay.

However, you cannot create the stuff from scratch. You would probably be violating copyright and trademark rights of the NFL and the individual teams.

This is general advice which may or may not apply to your situation. You should get a full consultation/opinion from an attorney before moving forward.
