being sued for sub contracts wrong dueing

we hired a contracter to do concrete work at my house. the contractor hired a sub-contracter to do the contrete work. the sub-contracter spill some gravel on the street causing an accident. so the plantiff is sueing us and the sub-contractor for damages and injurys. i just want to know are we responsible or the main contractor in responsible.

I agree with the other two posts. However, if you want a taste of the applicable law, just know that GENERALLY, a homeowner will not be liable for the negligence of an independent contractor (provided that contractor is licensed and provided the negligence doesn't arise out of a breach of a non-delegable duty).

There are potentially volumes of other things to consider but that is a slice of the applicable law.

If you have been served with a summons and Complaint in California, you need to find an attorney to file an answer within 30 days.

That attorney will explain how, if at all, you might be liable here.

Let your homeowners insurance company deal with this. They will tender it to the contractor. (In other words, they ask the contractor's insurance to pay for your defense and any judgment.)
