Legal Question in Credit and Debt Law in California

30 day Summons to civil case

I have recieved a summons to court for a cell phone bill from 2003.

My question is what do I do next it says I have to file a written response. What is that?

What form do I file?

I really just want to settle the 1816.00 owed but I don't have any money to pay the full amount.

I would hire an Attorney but im low on cash.

Thank you

Re: 30 day Summons to civil case

If you didn't pay the bill since 2003 and the lawsuit was filed in 2008, it might be time-barred by the statute of limitation.

You can find a form answer at http://www.courtinfo.ca.gov/forms/. You want the Answer-Contract. Make sure to type in affirmative defenses that include the statute of limitations and, if the amount is not owed or excessive, to state that, as well.

In addition, the court has a fee waiver program for which you might qualify, depending on your income and assets. You can find those forms and instruction sheet at the same website. Good luck.
