Legal Question in Credit and Debt Law in California

debt collection summons

I have been served a summons for an unpaid credit card debt, the court date is after the 4 year statue of limitations.

However, the summons date is two months before the statue of limitations.

Can I still use the statue of limitations as a valid defence?

No. The statute of limitations goes until the lawsuit is filed. I talked about this on my website, www.californiadebtblog.com
