Legal Question in Credit and Debt Law in California

My husband received paperwork to fill out to re-evaluate his child support. Why is it asking for my income information? Can they take my money too? We also have two small children together and can't live on much less than we are getting now.

No, they cannot take your money, unless he is in arrears on payments owed and your money is in a joint account with him. The reason they need your information is that the computer program that calculates child support takes into account your two children, and your income, in determining estimated taxes on HIS income. Support is based on after-tax income, and since your income affects his taxes, it must be disclosed, but it is not added into the income available for support payments. Also, he needs to be sure to take the hardship deductions for your two children together.
