Legal Question in Criminal Law in California

I have a 12 year old son who was caught with hash oil at school , and given a citation to meet with probation within 15 days. (felony )What should i expect when we go and talk to probation? He is not on probation .What should i say and not say? How to find out if they are going to file, off the record, or dismiss. If they are going to file i have to get an attorney, or is it better to have one when attending the probation meeting?Does anybody know about how much it will cost to obtain one for this case?

I believe you need an attorney for the hearing with probation. I don't know what area you are in, so I don't know what attorneys in your area would charge. In the 100's that our office had done over the past 20 years, our retainers range from 1500.00 to 2950.00 for all the preperation, all questions and advise, and the appearance at the hearing. I wish you well..........David Wallin

The purpose of the probation meeting is for the probation officer to meet your son and determine his suitability for probation. Leaving the probation officer with the impression that this was a one time thing, and that your son is not a chronic repeat offender who needs to be placed in California Youth Authority is important. The probation officer will want to know about your son, his hobbies, and the strength of his ties to his family, to determine if he has support or more court intervention in his life is necessary.
