Legal Question in Criminal Law in California

I was 17, she was 20/21 yrs old. Statutory Rape?

Around 09/1992 I was 17 yrs old. It was unheard of that a male could be victim of rape by a female adult. so it was never reported. she tricked me, forced herself ontop of me held me in til I ejaculated. I tried to deal with it but couldn't, stopped seeing her. couple weeks later she said she was pregnant and didn't want anything from me. and disappeared. 9 months later til present day I have been harrased for support. isn't that rape? is it too late to file a charge? how bout now that it has been recognized that boys can fall victim too? why didn't I get the option to abort or give up for adoption like female rape victims get the option to do? I've always felt like a victim, and never got any justice. theres got to be something that can be done to bring justice. this thing has troubled my life phsycologically, emotionally, mentally, financially, sexually, it's even forced me to stop going to school because I couldn't afford to live on a part time job being a full time student.

Re: I was 17, she was 20/21 yrs old. Statutory Rape?

If the incident you describe occurred in California then it was statutory rape. It may even have been rape by force or violence. After 16-plus years, though, it is too late to prosecute the woman. I understand your desire to see justice done, but a criminal case is now out of the question.

You ask why you didn't get the option to put the child up for adoption or to have the pregnancy aborted like a female rape victim. The answer is simple -- because you were not married to the mother and because the baby was not growing inside your body. Even in your situation, giving you such power over the woman would have been unjust.

I don't know what the law says about your responsibility for child support. You may want to submit your question under Family Law so that lawyers with the relevant expertise will see it.

Good luck.
