Legal Question in Criminal Law in California

parole search

My live in boyfriend is on parole and i just wanted to know if they can search my underware drawer which has none of his things in it. we do share the bedroom but i am in no kind of parole or anything else to do with the law. when the police do there parole searches are there any guidelines they must follow?

Parole Searches have been the source of a lot of caselaw over the years, the basic guidelines are that they can search common areas accessible to the parolee and roomates, or family members, this includes cars, furniture etc.. the only way to maintain privacy is to have a seperate, locked room inside of your house that is clearly defined as separate from the parolee,, this usually applies when the parolee has a roomate that lives in a separate bedroom,,absent that, all is fair game to the parole officers and the police,,,good luck,,,pdm
